Driven by Justice. Committed to Your Case

Jeffrey Linehan has made New York City home since 2005. After an early career in publishing, he obtained his Juris Doctor degree from New York Law School in 2010, and immediately pursued a career as a trial lawyer with the New York County District Attorney’s Office.

Mr. Linehan started felony practice early assigned to the Office of the Special Narcotics Prosecutor, where he used search warrants, electronic eavesdropping, confidential informants and undercover officers to make cases. Most importantly, he learned when to take a case to trial, and when a good offer was justified. Mr. Linehan began focusing his investigations on medical fraud, and eventually led a unit at the DA’s office pursuing charges of fraud and forgery (“Lawyer for Duane Reade Busted for Stealing 13,000 Percocet Pills with Pilfered Prescription Forms,” NY Daily News, June 21, 2012; “Prescription Fraud Charges for Prominent Manhattan Dermatologist,” New York Times, July 9, 2014), unlawful prescribing to patients whom physicians knew were selling their habit-forming pills (“Manhattan doctor who sold oxycodone prescriptions at $125 a pop sentenced to five years behind bars,” NY Daily News, June 17, 2015; “Doctors Charged in Drug Scheme at Clinic Controlled by Traffickers, Authorities Say,” New York Times, Feb. 5, 2014, “Elderly doctor, wife sentenced to prison for running $80M ‘pill mill,’” New York Post, Sept. 6, 2018; “Queens ex-doctor stockpiled 1.5M amphetamine pills and prescribed the drugs to patient who died using them,” NY Daily News, Aug. 17, 2016), and even manslaughter (“New York City doctor charged with manslaughter in overdose deaths,” ABC 7 NY, June 7, 2018), with the assistance of analysts, investigators, and expert witnesses.

Mr. Linehan next spent several years building complex white collar crime prosecutions at the New York State Attorney General’s Criminal Enforcement and Financial Crimes bureau. Using the fraud penalties of the “Martin Act” sunshine law, he litigated charges against fraudulent startups (“AG James Announces Criminal Indictment of Former Tech CEO for Defrauding Investors Out of Over $22 Million,” NY AG Press Release, Sept. 3, 2020), companies duping investors making cryptocurrency investments (“SA entrepreneur Eran Eyal convicted in US over fraudulent Shopin ICO, Springleap startup,” Ventureburn, Dec. 13, 2019; “Alleged Shopin ICO Fraudster Pays $450K Fine in Ether,” Coindesk, June 3, 2020), and traders who simply stole customer funds (“Forest Hills stockbroker convicted for bogus currency trading scheme,” Queens Eagle, Nov. 22, 2019).

Mr. Linehan went on to enforce the self-dealing prohibitions of New York’s Public Officers Law with the Joint Commission on Public Ethics (now known as the Commission on Ethics and Lobbying in Government) as an ethics enforcement counsel. Investigations exposed hidden financial gains of elected and appointed politicians, conflicts of interest between lobbyists and legislators who made law on the industries they promoted, and the suspect practices of former Governor Andrew Cuomo (“Ethics Commission Hits Back at Cuomo, Seeking $5M book repayment,” Albany Times-Union, May 9, 2022).

Mr. Linehan opened this firm to help people avoid the serious consequences that can arise from law enforcement’s actions. For some that could mean a hefty fine, years of imprisonment, or public embarrassment. For others, the loss of a professional license, or an impact upon their future livelihood or immigration status. In addition to advocating for private clients, Mr. Linehan serves on the New York State’s Assigned Counsel Panel, defending New Yorkers who could not otherwise afford an attorney in felony and misdemeanor prosecutions. He also serves on the New York City Bar Association’s Criminal Courts committee, moderates and prepares the Bar’s annual “Criminal Law 101” education course, and has been featured in the Associated Press.

The Linehan Law Firm knows how the government builds these cases. We look forward to getting you the best result possible.
